General Terms and Conditions of Business
We are working exclusively according to German Freight Forwarders Standard Terms and Conditions (ADSp) latest edition. Especially we like to mention the reduced liability according to Article 23. These limit, in paragraph 23 ADSp, the legal liability of damage of goods in the case of damage to goods while the cargo is in the care of a forwarder to 8,33 SDR/kg, in accordance with §431 of the German Commercial Code (HGB); in the case of multimodal transports, including sea transport to 2 SDR (special drawing rights)/kg plus, in addition, per damage or event to 1,25 Million EUR or 2,5 Million EUR respectively, or 2 SDR/kg whichever is the greater. Paragraph 27 ADSp does not constitute an agreement for alternative maximum liability sums concerning paragraph 27 of the Montreal Agreement. The link to the complete wording of ADSp is on this website under the section 'Facts & Figures'. Upon request we will also be pleased to provide them to you in writing. We have taken out a freight forwarding insurance policy in accordance with art. 29 ADSp. Place of jurisdiction and place of performance shall be Bremen.
